  1. SEGMENTO REMOTO, LDA., and its brands

SEGMENTO REMOTO, LDA., and its partners, are the sole holders of the rights and trademarks “Flowers to Fatima”, “Flores para Fátima” and the Logo (Nossa Senhora, Santuário e Flor) in Portugal.

These sales conditions apply to all offers on this website, issued by “Segmento Remoto – Lda.” and for its trademarks – referred to above -, headquartered at Rua da Rainha Santa Isabel, no. 6, Bloco C, 2495-424 Fátima, with NIPC 516.426.290 and, also, to all agreements and relations concluded between the “Segmento Remoto – Ltd.” and any customer/consumer who places orders through this website.

The general conditions of sale are the only ones to be applicable and they replace all other conditions, except for prior express agreement in writing. “Flowers to Fátima” may from time to time modify certain provisions of its general conditions. Thus, we consider that when the order is validated, the customer is automatically accepting our general conditions of sale.

  1. General Conditions of Access and Use of the Website www.flowerstofatima.com

This Site and its use are subject to Portuguese and English law.

This website (hereafter Site) is intended to provide visitors, users and customers with the products and services that “Flowers to Fatima” makes available to the customer/recipient, in mainland Portugal and in any international destination.

“Flowers to Fatima” undertakes to resolve, in the mutual interest of its customers, any disputes that may arise within the scope of an order (due to customer or recipient complaint), and that the customer or recipient may not or may not wish to resolve directly with “Flowers to Fátima”.

“Flowers to Fátima” is not responsible for the content of the personal message chosen by the customer and delivered together with the product to the recipient.

The information about the products contained on the Site is for information purposes only, as well as the photographs are only illustrative and exemplary of the final product. For advice or additional information about the products and services, the user should contact “Flowers to Fatima” directly through the email info@flowerstofatima.com

 

  1. Orders

The various products featured on this website are grouped into various groups. These groups are identified on the “Shop / Store” page. By choosing one of these groups, you will have access to the category belonging to the selected area, as well as the list of product(s). Within each of these groups there can be aggregated subcategories. When selecting a category or subcategory, you will have access to the list of products.

The products displayed on the website that you wish to order must be placed in the shopping cart using the “Add” option. You can also obtain more detailed information about the products displayed by clicking on the product name to access detailed images of them, their designations and references, characteristics, other models, etc.

Only with this acceptance by “Segmento Remoto – Lda.” the agreement binding www.flowerstofatima.com and the customer will be formed, and which these conditions of sale are part of. “Flowers to Fatima” may withdraw, at any time, any offer or change the indicated price until the agreement with the customer exists. “Flowers to Fatima” cannot be held liable for any typographical errors.

The prices shown already include the final value with taxes. The delivery value varies depending on the delivery area to be selected at the end of the order, so the flower delivery area must be chosen correctly.

  • Deliveries in Portugal

For deliveries in Portugal, “Flowers to Fatima” guarantees delivery within 48 hours, provided that the order is placed in advance on working days, and until 11:00 am (local time) on Saturday, unless the delivery day is a public holiday local at destination or nationally.

For orders destined for delivery on special days (Mother’s Day, Valentine’s Day, etc.), it must be placed at least 96 hours in advance.

  • Deliveries abroad

“Flowers to Fatima” guarantees the delivery of the order within a minimum period of 5 to 30 days from its completion. Deliveries on National Holidays in the country of destination are not guaranteed.

For all orders, whatever their destination, “Flowers to Fatima” guarantees delivery during business hours, but never at specific and specific times. The hours indicated are based on the time in mainland Portugal.

 

  1. Shopping cart

Once you have placed all the products you want to order in the shopping cart, you will be able to proceed and complete your order.

For this purpose, you should observe the following steps

  • Step 1 – Identification and registration. If you have already logged in, you can go to Step 2;
  • Step 2 – Billing Account and Address;
  • Step 3 – Delivery Address;
  • Step 4 – Delivery Method;
  • Step 5 – Payment Method; and
  • Step 6 – Confirm Order

After confirming your order, you will receive an order receipt response email. Confirmation of the availability of the ordered products and acceptance of your order will be made via email or, if this is not possible, by telephone.

 

  1. Means of payment

The payment methods are:

  • MB Reference
  • MB Way
  • Payshop
  • VISA / Mastercard

 

  1. Returns and Exchanges
  • Orders not delivered to the customer/consumer.

In the event that a prepaid order is returned to “Flowers to Fatima” for reasons not attributable to “Flowers to Fatima” or the freight forwarder/distributor, “Flowers to Fatima” will reimburse the amount paid for it, deducted from the costs of shipping and return.

The customer can opt for a refund in the original payment method or through a refund coupon that can be used in a future order. The coupon will be valid for 6 months from its creation date. After this period, there will be no refund of any kind. In case the original payment was made by Bank Transfer, the customer will have to provide the bank details for the refund to be made.

If the reason for non-delivery and return of the order is the responsibility of the freight forwarder, regardless of the payment method chosen, the customer will have to send us a written complaint that will be analyzed by the freight forwarder/distributor. In case the problem with the delivery was caused by an incorrect or incomplete address, we ask that the customer attach a proof of address (eg electricity, water or gas bill) to the claim.

The solution that “Flowers to Fatima” will present to the customer will depend on the response given by the freight forwarder. Thus, in cases of complaints originated by the transport service, we will only be able to present a solution to the customer after we obtain an answer from the freight forwarder.

If the distributor accepts full responsibility for the return of the order and if all items originally ordered are available, we will suggest the customer to resend without additional cost.

If the freight forwarder does not accept responsibility, we will not be able to accept the claim, which means that the refund or replacement order will be subject to the above mentioned terms relating to orders returned for reasons not attributable to “Flowers to Fatima” and the freight forwarder.

  • Returns

If the customer intends to return one or more products, they may do so within 15 days of receiving the order, provided that the product is intact, sealed, complete and in the original packaging, which cannot be damaged or altered or crossed out. The customer must ensure that the returned item(s) arrive(s) at our facilities within 28 days of delivery.

To exercise their right of return, the customer must contact by telephone or by email, specifying the order number, description or reference of the product(s) they wish to return and which form of refund they want. The refund can be made through the original payment method or through a refund coupon, which is valid for 12 months from the date of issue. After this period, there will be no refund.

The customer will also have to pay attention to whether the product he intends to return was purchased as part of a promotional campaign and if, for this reason, he benefited from any product offered. If this is the case, you must return not only the product in question, but also the gift that was awarded to you with your purchase. Both products must comply with the aforementioned guidelines.

It is only possible to return one pack in its entirety. If the customer intends to return a product that belongs to a pack, he must return all the products that make up that pack. All products must comply with the aforementioned guidelines.

Returns of incomplete, damaged or scratched products, as well as products without the original packaging and/or label, or products with signs of having been used, will not be accepted.

  • Exchanges

Once the purchase is made and confirmed by the consumer, no exchange will be possible on the product ordered and confirmed.

 

  1. Refund Methods

“Flowers to Fatima” will endeavor to refund the customer quickly, safeguarding, however, a maximum period of 15 days from receipt of the return in our warehouse. If payment was made by credit card, the refund will be made to the card itself and will appear on the next credit card statement.

The customer can also choose to be refunded via a discount coupon, regardless of the original payment method. The coupon will be valid for 6 months from its creation date. After this period, there will be no refund of any kind.

If the reason for returning the order was the responsibility of “Flowers to Fatima”, we will refund the respective shipping costs (example: products different from the items actually ordered). However, if, in an order for multiple products, only one has had a problem, we will not refund the shipping costs.

 

  1. Consumer Obligations

The user undertakes to:

  • Provide personal data and correct addresses;
  • Do not use false identities

If any of the data is incorrect, that is, insufficient, and for this reason there is a delay or impossibility in processing the order, or any non-delivery, the responsibility is the Customer, and “Flowers to Fatima” declines any responsibility.

In case the consumer violates any of these obligations, “Flowers to Fatima” reserves the right to eliminate future purchases, block access, cancel the supply of any other services provided simultaneously by “Flowers to Fatima” to the respective Customer.

The use of purchased products for commercial purposes is expressly prohibited, namely for the purpose of resale of goods.

 

  1. Rights as a seller:
  • “Flowers to Fatima” reserves the right to cancel or suspend any delivery whenever it is not requested in accordance with the specified conditions;
  • Observing the seasonal and perishable nature of most of the articles made available to “Flowers to Fatima” reserves the right to substitute or change any article in the event of its unavailability, whether in species, genus, color or variety;
  • “Flowers to Fatima” reserves the right not to make the delivery whenever the recipient refuses it, or is absent and it is not possible to make the same with someone who replaces him;
  • The orders will be considered as placed after confirmation of payment, observing from that moment the fulfillment of the delivery timings;
  • “Flowers to Fatima” reserves the right to contact the buyer whenever this becomes essential for the ideal provision of the service to be carried out;
  • “Flowers to Fatima” reserves the right to maintain the confidentiality of the identity of its customers, unless they request otherwise;
  • “Flowers to Fatima” will send its customers, upon request, periodic information in the form of a newsletter, which may contain information about discounts and promotions;
  • “Flowers to Fatima” reserves the right to subcontract entities or companies in order to guarantee the proper fulfillment of the services

 

  1. Privacy Policy and Personal Data Protection

“Flowers to Fatima” informs the customer that the personal data requested are the minimum necessary for the execution of the contracted service. In no case will the personal data obtained during the ordering process or any subsequent communications be used strangely or beyond what is strictly necessary for the execution of the order or the resolution of any incidents related thereto.

The purpose of data processing is thus the correct execution of the service and ordering “Flowers to Fatima”. The collected data may, however, be used to carry out surveys, statistics and analysis of market trends, as well as to create user profiles in order to improve the “Flowers to Fatima” service, without prejudice to your rights of access, opposition, cancellation or rectification.

To exercise these rights, you may send a written communication to “Segmento Remoto – Lda.” to Rua da Rainha Santa Isabel, no. 6, Bloco C, 2495-424 Fátima, as the person responsible for the treatment, indicating the details of your Citizen’s Card or email to info@flowerstofatima.com.

When the personal data of the recipient of the order is not provided by the recipient, “Flowers to Fatima”, directly or through the entity that has carried out the order, will inform the recipients, within three months following the registration of the data, of the content of the data made available , origin thereof, existence and purpose of the file in which they are stored, possibility of exercising access rights, rectification, cancellation.

  1. Pricing and Limitation on Existing Stock

Prices are shown in euros and include the respective fees and taxes (VAT). The prices indicated are exclusive for purchases through this website.

The availability of the products presented on the website is limited to the existing stock at any given time. Prices and other descriptions are subject to change without notice, including due to restocking.

 

  1. Ownership of Content and Distinctive Signs

All data and content on the website, including distinctive trade signs, are the exclusive property of “Flowers to Fatima” or third parties and as such are protected by law.

 

  1. Content Errors

A “Flowers to Fatima” não assume qualquer “Flowers to Fatima” assumes no responsibility for any errors in the content of the website and the information provided. “Flowers to Fatima” makes every effort to ensure the accuracy and conformity of the website, reserving the right to freely change the contents of the website, at any time and without prior notice.

“Flowers to Fatima” will not be liable for damages and inconveniences arising from the use of the Internet, including, for example, as a result of the disruption or failure of the service and access, external intrusion or the presence of computer viruses, or any case of force majeure.
